General Terms and Conditions of Sales

These General Terms and Conditions of Sales define the business relationship between Watermelon and the customer. When the customer buy at Watermelon he/she accepts the following terms and conditions.

Products

Watermelon is a company specialized in personalization and customization of textile garments for individuals and companies.

Price

The prices are quoted in Swiss Francs (CHF). Watermelon doesn’t apply VAT. Shipping costs are charged separately and mentioned during the ordering procedure. Only the confirmation of order from Watermelon sets a sale agreement.

Payment

Watermelon use Paypal as payment method.

Delivery

Delivery is conducted by a shipment service provider chosen by Watermelon. Watermelon can’t be held responsible for any belated or failed delivery in case of wrong or incomplete address information. Shipping costs are given during the ordering procedure. For an order of less than 10 items, delivery is usually complete within 15 days starting from the date the customer receives confirmation of his/her order. A longer delivery time may be expected for larger order. Watermelon can’t be held responsible for cancelled or partial deliver in case of outage from suppliers.

Refund

Watermelon sales personalized products. So Watermelon doesn’t proceed to refund. But Watermelon does refund in case of obvious defect product noticed within 10 days after delivery. Here are the obvious defects covered :

  • wrong location of print despite clear instructions from the customer (a slight variation may still occur and be accepted by the customer)
  • wrong color of print or embroidery despite clear instructions from the customer (a slight variation of color may still occur and be accepted by the customer)
  • wrong size of print or embroidery despite clear instructions from the customer (a slight variation of size may still occur and be accepted by the customer)
  • typo error
  • mistake in the reference number recorded
  • obvious fault concerning the quality of the garment
  • obvious fault concerning the quality of the print or embroidery
  • Watermelon declines any responsibility in case of typo made by the customer or low quality of image provided. The customer is the only one responsible for spell check and check the image quality.

    Copyrights to Print and Embroidered Designs

    The customer assures Watermelon that the text and motif are not subject to any rights held by third parties. In such case the cost of any breaches of copyright, personal rights or rights to the use of a name will be borne solely by the customer. The customer also assures Watermelon that by personalising the product he is also not breaching any other rights held by third parties.

    Release from Liability

    Watermelon refuses to print or embroider any racist or pornographic content. Watermelon may decline any order due to technical or commercial reasons.

    Litigations

    Tribunal of Lausanne is the place of general jurisdiction regardless of places of delivery.
